Purchase agreement

 
 

 

NOTE: These are the general rules by which we do business. You are responsible for having read, and agreed, to all of them when you agree to purchase an animal from us or place a deposit with us.  They are subject to change at anytime at our discretion. Other than that, shoot us an email with any questions. We'll do our best to work with you so that everyone is satisfied; I can promise that to you.
 
  • If you receive a snake from us and are having trouble getting it to eat, we must be notified within 2 weeks of receipt of the animal before you take any exceptional actions under your own cognizance.  Normally, we will tell you to allow the snake to acclimate for another week before doing anything (since it has had numerous meals before we shipped it) and ask very specific questions about your husbandry techniques.  Failure to contact us within the allotted time frame or to provide complete answers (and proof if required) to our questions invalidates all warranties.
     
  • We will sell snakes outside of the United States, but we will not export them directly.  We are not licensed exporters, but we will ship to a licensed exporter of your choice (within the United States) for legal exportation to your country.  We normally guarantee live arrival to your exporter of choice, but we do not guarantee anything once your exporter accepts delivery of the live animals.  Your shipping guarantees from the exporter to you are not the responsibility of KJUN Snakehaven.  We do not recommend any particular exporter, but we can give you the contact information of some that we have used in the past.  Expect export fees of typically $300-1200 dollars per order, but that will be arranged between you and your exporter (not KJUN Snakehaven).  Wholesale lots are frequently available for our larger export customers.  Please contact us for more details. 
     
  • Special discount coupons are only valid for certain forms of payment, and they can not be combined with any other sale, or reduced price, animal order.   Ask about discounts on multiple snake purchases. You may not be eligible for this if we let you place an order heavily weighted towards one sex or the other.
     
  • We do accept deposits on our expected production; however, this deposit is nonrefundable if we produce the animal(s) you reserved with that deposit.  Our acceptance of your deposit guarantees that we expect to produce the animals on which we accept a deposit, reserves your place in line for that animal, and guarantees you that animal(s) at that price regardless of if prices increase after you place your deposit.  Deposits (normally 10-25% of the total value of the reserved animals) are non-refundable if we produce the animals but are fully refundable and/or transferable from us on animals that we do not produce.  In limited cases with prior approval from us, deposits can be transferred towards animals other than the ones you reserved.  NOTE: Checks or money orders are preferred for deposit payments.  Paypal is accepted, but paypal fees will not be refunded if a refund needs to be issued for any reason. 
     
  • Unless other arrangement are made in advance, no animal is considered sold until we have received payment for that animal.  An inquiry into an animal (or a statement such as "I want it") does not necessarily reserve than animal for you for any amount of time. Unless I specifically state an animal is held for you awaiting payment, it is still available for sale to the first paying customer.  Under no condition should you expect animals to be held more than four (4) days while I await payment unless specifically agreed upon in advance.  Appropriate sales taxes, if not already included in the listed sales price, will be charged on all Texas sales. 
     
  • Unless otherwise agreed upon, all of the snakes we sell are guaranteed to have fed at least twice on appropriately sized rodents (live and/or thawed mice or rats) before they will be shipped. They are also guaranteed to feed for you except for the exceptions listed in this purchase agreement. This does not apply to snakes that were bought "out-of-the-egg" or at a discounted price regardless of if they are currently feeding. Special arrangements on those purchases will be made on a per purchase basis.  We do not guarantee that any particular snake will eat thawed rodents (as compared to live/pre-killed rodents) unless specifically agreed upon prior to a sale.  Most of our snakes will be feeding on thawed prey items as a convenience to ourselves (with some minor exceptions such as many sand boa babies), but we do not guarantee that hatchlings sold will feed on thawed for the buyer unless specifically agreed upon in advance.
     
  • Many of our snakes can be purchased in wholesale lots right "out-of-the-egg" (i.e., with no feeding guarantee) at a significantly discounted price before they become available on the standard market. Please contact us if you are interested in such purchases.  Due to our busy work schedule, we would prefer to wholesale animals "out-the-egg" in 20+ lots to interested individuals.  Wholesale lots (even if sold as established feeders) are sold "as is" with no understood or implied feeding guarantee.  (However, live arrival is guaranteed the same as on retail sales!)  Unless specifically stated  in advance, there is NO guarantee on sex ratio of a wholesale lot.  Unless stated in advance, wholesale prices are quoted as check, cash, or money order prices only.  Paypal/credit card payments are usually not be accepted for wholesale orders.
     
  • We reserve the right to change prices at any time based on our estimate of the current market value.  All animals are individually priced according to quality.  Animals reserved with a 25% deposit will not be charged a greater price regardless of changes in market value, and sales held with a deposit always get the highest quality animals available at that price.  
     
  • Payment must  be received in full before the snakes will be shipped. Preferred payment method is by PayPal, money order, or wire transfer. Personal checks will be accepted but must clear before shipping. Credit cards are accepted through PayPal - you do not need a PayPal account to pay us with credit cards.  Not all forms of payment will be accepted for all transactions, especially on large and wholesale orders. 
     
  • Due to increasing fuel costs, FedEx rats have been changing regularly.  Shipping costs will be determined on a case-by-case basis (if necessary), but you should assume shipping to be approximately $50 per order.  Residential addresses will have a higher shipping rate than business and "hold for pick-up" addresses.  There is no minimum order size, but shipping charges for small orders may include a $5-10 "box" fee.  You can track your order by FedEx here.
     
  •  Live animals are safely secured (cupped and/or bagged) inside of an insulated shipping box surrounded by a "cushioning" medium.  Cool or heat packs are included in each shipment as necessary for no additional fee.  We do everything possible to minimize the stress on the animals being transported.  During excessively cold or hot weather conditions at the recipient's address, live arrival guaranty may only apply to "hold for pickup" shipments and/or business address shipments.  A live arrival guarantee is almost never offered on addresses not guaranteed to arrive by 10:30am.  It is the recipients responsibility to check on arrival time - we just ship to the address you provide to us regardless of FedEx's estimated arrival time.  We are not responsible for problems associated with a shipper's delay.
     
  • Live arrival is guaranteed on Monday-Wednesday shipments to addresses with guaranteed delivery on or before 10:30am if the package is received on its first delivery attempt.  Except for problems caused by shipping condition, common carrier, or any errors outside of our control, all animals are guaranteed to arrive properly sexed and healthy as long as delivered by 10:30am.  Someone must be present to sign for the package on its first delivery attempt or all guarantees and warranties are voided.  It is the recipient's responsibility (and not that of KJUN Snakehaven) to confirm guaranteed delivery by 10:30am by FedEx to the supplied shipping address.  FedEx does not guarantee 10:30am delivery to many addresses, and we can not guarantee live arrival to such addresses.  If you insist that we ship on a day (or at a time) of your choosing against our recommendations, you accept all liability and our live arrival guarantee is void.
     
  • Any errors or points of dissatisfaction must be reported to us within 24 hours for possible credit or replacement. DOA must be reported within 4 hours of delivery.  Make sure to hold any injured or dead animals until we say otherwise.  Dead animals should be stored in the refrigerator to prevent decomposition.  If we don't hear from you within 24 hours, we will assume that you are completely satisfied and any/all possible credits or replacements are no longer available.   
     
  • The above 24 hour time limit does NOT apply to the feeding guarantee on all of our animals sold as "guaranteed to be feeding on unscented mice of appropriate sizes."  As a matter of fact, you SHOULD wait at least 2 days following arrival of your snakes before offering them food.  This gives the them time to adjust to their new cage, hydrate (immediately providing them with a water bowl is a must), and to calm down.  Snakes fed immediately after arrival may regurgitate the meal due to stress levels resulting from shipment.  If fed within 48 hours of arrival, all guarantees we have on the animal(s) are void.  Please wait 48 - 72 hours before feeding your new snakes for the first time.  They are plenty healthy enough to wait that long, and it is much safer for the snake.  Water should be provided to your new snake(s) immediately since shipping is a dehydrating experience for snakes. 
     
  • Husbandry practices must be correct or all guarantees are void.  Be prepared to prove your set-up is correct in the rare cases that something might go wrong.  We will require specific answers to our questions.  If you take inappropriate actions with your snake - or attempt incorrect feeding measures - all warranties are void.  If you are having any issues, problems, or concerns, you must seek and follow our advice immediately or all warranties are void.
     
  • Please remember that we will always do our best to help you. If you ever have any questions in the future, feel free to contact us.  We do everything possible to make sure that your snakes will arrive alive, feed well, and thrive with you.  Don't forget that you must wait 48-72 hours after the arrive to offer them their first meals, but they should be set up in their cage with a proper water bowl and hide boxes immediately upon arrival.
     
  • A snake's temperament is not a valid reason for dissatisfaction.  Almost all will calm down with proper handling.
     
  • You will be responsible for all shipping costs. This means return and replacement shipping costs (unless the error was ours), too. Additionally, we can not be held responsible for shipping delays (or other deleterious events) beyond our control.  Again, any shipping charges on return for replacement animals are the buyer's responsibility to pay. 
     
  • No other liability is taken or assumed by us.  All purchases are dependent upon the laws of your state. You are responsible for the legality of your purchases.  We do our best to try and verify all shipments once payment is received. If the shipment turns out to be illegal, your money will be returned in full. Obvious illegal transactions will be handled accordingly by us (i.e., reported to the proper state and federal authorities).
     
  • All purchases are subjected to all of these rules. All of the pictures on this website, unless otherwise specified, are the sole property of KJUN Snakehaven and cannot be used without our expressed written permission.
